The Welfare of Animals at the Time of Killing (Consequential Amendments) (Wales) Regulations 2014
EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations make amendments consequential on the Welfare of Animals at the Time of Killing (Wales) Regulations 2014 (S.I. 2014/951) (W. 92).
They make consequential amendments to three Acts of Parliament and one statutory instrument to provide that those Acts and instrument refer to certificates of competence and licences issued under the Welfare of Animals at the Time of Killing (Wales) Regulations 2014.
No regulatory impact assessment has been prepared in respect of this instrument as no costs to the business or voluntary sector is foreseen.

The Welsh Ministers are designated for the purposes of section 2(2) of the European Communities Act 1972([1]) in relation to the common agricultural policy of the European Union([2]) and make these Regulations in exercise of those powers.
Title, application and commencement
1. These Regulations—
(a) are entitled the Welfare of Animals at the Time of Killing (Consequential Amendments) (Wales) Regulations 2014;
(b) apply in relation to Wales and consequently the amendments made by regulation 2—
(i) extend to England and Wales; and
(ii) apply in relation to Wales only; and
(c) come into force on 5 September 2014.
2.—(1)(1) In
section 10 of the Firearms Act 1968([3]) (slaughter of
animals)—
(a) in subsection (1), for “licensed under the Welfare of Animals (Slaughter or Killing) Regulations 1995 to slaughter horses, cattle, sheep, swine or goats” substitute “holding a relevant licence”; and
(b) after subsection (1) insert—
“(1A) For the purposes of subsection (1) a person holds a relevant licence if that person—
(a) is licensed under the Welfare of Animals (Slaughter or Killing) Regulations 1995 to slaughter horses, cattle, sheep, swine or goats; or
(b) holds a certificate of competence or is licensed under the Welfare of Animals at the Time of Killing (Wales) Regulations 2014.”
(2) In section 16(1)(c) of the Slaughterhouses Act 1974([4]) (management of public slaughterhouses), after “the Welfare of Animals (Slaughter or Killing) Regulations 1995” insert “or the Welfare of Animals at the Time of Killing (Wales) Regulations 2014”.
(3) In Schedule 1 to the Animals (Scientific Procedures) Act 1986([5]) (appropriate methods of humane killing), in Table A, in the left-hand column of the fifth entry, after “a current licence granted under the Welfare of Animals (Slaughter or Killing) Regulations 1995” insert “or a certificate of competence or licence issued under the Welfare of Animals at the Time of Killing (Wales) Regulations 2014”.
(4) In paragraph 12 of the Schedule to the Gangmasters Licensing (Exclusions) Regulations 2013([6])—
(a) delete the word “or” after sub-paragraph (a); and
(b) after sub-paragraph (b) insert “or;
(c) a certificate of competence or licence to kill animals under the Welfare of Animals at the Time of Killing (Wales) Regulations 2014.”
